Website & auction terms
Last updated 2 November 2026
These terms apply when you use www.sellmytruck.co.za, create an account, buy a unit or bid on our online auctions. By doing any of those, you agree to them and to our privacy notice. If you do not agree, please do not use the site.

2. Our stock and the information on this site
2.1 We sell commercial vehicles, trailers and plant that we own. We do not sell on behalf of other people, on the floor or on auction.
2.2 We describe every unit in good faith, but descriptions, specifications, mileages, hour readings and photos are a guide only and may contain errors. Please inspect a unit, or have it inspected, before you buy or bid. Inspection is free, by appointment, at our Muldersdrift yard.
2.3 Retail prices may change, and a unit may be sold or sent to auction at any time until a sale is agreed with you. A price on the site is an invitation to deal, not an offer. A floor sale is concluded only when we confirm it in writing and receive payment or an agreed deposit.
2.4 Each listing states whether its price includes VAT.
3. Voetstoots
3.1 All units, bought off the floor or on auction, are sold voetstoots: as is and where is, with all faults, and with no warranty or guarantee of any kind, as section 55(6) of the Consumer Protection Act 68 of 2008 (CPA) allows where the buyer has been told of the condition of the goods and agrees to accept them in that condition.
3.2 By buying or bidding, you confirm that you have inspected the unit, or chosen not to, and accept its condition. A unit may need repair before it can be driven safely or legally.
4. Accounts
4.1 You must give true and complete details when you register, and keep them up to date.
4.2 Keep your password private. You are responsible for everything done through your account, including bids, until you tell us it has been compromised.
4.3 We may suspend or close an account that breaks these terms or that we reasonably suspect of fraud.
5. Registering to bid
5.1 Only approved bidders may bid. To be approved you must give us a copy of your identity document (or, for a company, close corporation or trust, its registration documents and proof that you may act for it), proof of residential or business address, and your contact details.
5.2 We may approve, decline or suspend any bidder at our discretion. You cannot approve yourself.
6. How our online auctions work
6.1 Each lot runs as a timed online auction, normally for 24 hours, between the opening and closing times on its lot page. Times are South African time and are decided by our system’s clock, not by the countdown on your device.
6.2 No commission, VAT included. We charge no buyer’s commission, buyer’s premium, online bidding fee or registration fee, and auction prices include VAT. The amount of your winning bid is the amount you pay. If a lot is ever offered on different terms, its lot page says so plainly before you bid, and those terms apply to that lot only.
6.3 Reserve. Every lot carries a confidential reserve price. The lot page shows whether the reserve has been met. If bidding closes below the reserve, the unit is not sold on auction and returns to our stock; we are not obliged to sell to the highest bidder, and that bidder is not obliged to buy.
6.4 Bids by the seller. Neither Sell My Truck nor anyone on its behalf bids on a lot unless that lot’s page states in advance that the seller may bid, as section 45 of the CPA requires.
6.5 Bidding. You may bid an exact amount, or set a maximum. With a maximum, our system bids for you one increment at a time, only as high as needed to keep you in the lead and never above your maximum. Your maximum is never shown to anyone. If two bidders set the same maximum, the one who set it first leads. The minimum increment depends on the current price and is shown on the lot page.
6.6 Extensions. A bid placed in the last two minutes of a lot extends its closing time by two minutes, so every bidder has a fair chance to respond.
6.7 Every bid is a binding offer to buy the unit for that amount, subject to the reserve. In line with the CPA, you may ask us to retract a bid before the lot closes by contacting us immediately. Once the lot closes, the winning bid is binding.
6.8 When a lot closes with its reserve met, the highest bidder buys the unit at their winning bid. We confirm this by email and issue a tax invoice.
6.9 Bidders may not act together to keep prices down, bid for someone else without authority, or interfere with an auction in any way. We may cancel bids, withdraw a lot or stop an auction before it closes, for example because of a technical fault, an error in the listing or suspected misconduct.
6.10 Other bidders see only your bidder number, never your name or contact details.
A plain-language summary is on our auction rules page. If the two ever differ, these terms apply.
7. Payment, risk and collection
7.1 Payment of the full invoice is due within 48 hours of the lot closing, or of a floor sale being agreed, by electronic transfer to the bank account on our invoice, unless we agree otherwise in writing. We do not accept cash.
7.2 Always confirm our bank details by phone on 081 211 7184 before paying. We will never change our bank details by email.
7.3 Invoices are issued to the registered bidder or buyer only, and cannot be split or changed to another name.
7.4 Risk in the unit passes to you when the lot closes or the floor sale is agreed, even while the unit stays at our yard. Ownership passes only once we have received payment in full in cleared funds.
7.5 You may collect the unit only after full payment reflects in our bank account. Collection is from our Muldersdrift yard by arrangement, during business hours.
7.6 Units not collected within five business days of payment are stored at your risk, and we may charge storage of R250 per day.
- Batteries and diesel are for the buyer’s account.
- We do not issue temporary permits.
- Registration, roadworthy certification and transport are the buyer’s responsibility unless we agree otherwise in writing.
7.7 If you do not pay on time, we may cancel the sale, re-sell the unit and claim from you any loss we suffer as a result, including storage and any shortfall on re-sale.
8. Electronic transactions
These terms are concluded electronically. Under section 42(2) of the Electronic Communications and Transactions Act 25 of 2002, the cooling-off right in section 44 of that Act does not apply to auctions.
9. Liability
9.1 To the extent the law allows, we are not liable for any loss or damage arising from your use of this website, from the website being unavailable, or from errors in listings, except where caused by our gross negligence or wilful misconduct.
9.2 Nothing in these terms limits any right you have that the CPA or another law says cannot be limited.
10. Website content
The text, photos, logos and design of this site belong to Sell My Truck or are used with permission. You may not copy them for commercial use without our written consent.
11. General
11.1 South African law governs these terms. You consent to the jurisdiction of the Magistrates’ Court under section 45 of the Magistrates’ Courts Act 32 of 1944.
11.2 We may update these terms. The version on this page when you bid or buy applies to that transaction.
11.3 If any clause is found to be invalid, the rest of these terms remain in force.
11.4 If we do not enforce a right immediately, we do not give it up.
11.5 We choose the address in section 1 as our address for legal notices (domicilium citandi et executandi).
